Dr. M. S. Sahoo along with our Founding Partner Mr. Sumit Agrawal, jointly authored an article published in Business Standard, on governance through disguised legislation.

The article explains that recent court rulings emphasise the limitations of circulars, which often exceed their intended scope. Legal norms should be prescribed through formal legislation, either primary or subordinate, rather than through circulars issued by bureaucracy. This would restore the balance of power from the executive back to the legislature, enhancing transparency and accountability.

Mr. Agrawal and Mr. Sahoo urge Parliament to impose a complete ban on disguised legislation and require that all legal norms follow the due process of law. This move would bolster democratic legitimacy and significantly improve the business environment by providing clearer, more predictable norms.
